TRIAL
Mikhail Khodorkovsky was arrested on 25 October 2003. Seven months later his trial began in Moscow and on 8 June 2004 it was combined with that of his associate Platon Lebedev (arrested in hospital in July the previous year). Both men were sentenced on 31 May 2005 to 9 years imprisonment. In September 2005 sentence was reduced, on appeal, to 8 years. On 16 October they were transferred to penal colonies in Siberia.

The circumstances of Khodorkovsky’s arrest – masked special forces armed with automatic weapons – proved a harbinger of how the Russian government would approach the case. In direct violation of the Russian Criminal Procedural Code, authorities placed Khodorkovsky and Lebedev in a detention facility in Moscow without court authorization.

The Moscow City Court concluded its hearings into the appeal filed by Mikhail Khodorkovsky. After considering the case materials and positions presented by both the defence and the prosecution, Judge Vyacheslav Tarasov and his two colleagues reached their decision in just one hour. Ultimately, the Moscow City Court upheld the guilty verdict issued by Meshchansky Court, with a one year reduction of the prison term.

The request by Anton Drel, Elena Levina, and Denis Dyatlev, defence lawyers for Mikhail Khodorkovsky, to be excused from the appeals process was upheld by the Moscow City Court and the trial was rescheduled for Thursday, September 22, 2005.

Anton Drel, Elena Levina, and Denis Dyatlev, lawyers who represented Mikhail Khodorkovsky during the trial, were present for today’s proceedings. They refused to represent Mr. Khodorkovsky, who noted that he wanted Genrikh Padva or Yuri Schmidt to represent him.

Lawyers for Mikhail Khodorkovsky were prevented from meeting with their client today due to a "strict quarantine" being place on Khodorkovsky's cell. The lawyers also said prison officials demanded documents from the Moscow City Court proving they represented Khodorkovsky.

The proceedings for appeals filed by defence lawyers representing Mikhail Khodorkovsky and Platon Lebedev began today in the Moscow City Court. Nothing substantive was discussed since lawyers representing Khodorkovsky and Lebedev were absent from the proceedings. As a result, the proceedings were postponed until Monday, September 19 at 11:00 a.m.
