Moscow City Court rejected prosecutor Grin’s appeal.
Mikhail Khodorkovsky and Platon Lebedev’s defence team have finally received the text of two rulings issued by the Moscow City Court in response to an appeal by deputy prosecutor-general Grin.
Prosecutor Grin intended to overturn earlier decisions by
the Basmanny District Court and
the Moscow City Court, which declared that it would be unlawful and unjustified to conduct preliminary investigations into new charges against the two men in Chita.
On June 13 Judge Vodolyanova of the Moscow City Court stated: ‘the rulings delivered with respect to M.B. Khodorkovsky and P.L. Lebedev are adjudged legal and well-founded. There are no grounds for the arguments of the supervisory motions seeking to overturn these rulings’. Not satisfied with this decision Prosecutor Grin appealed to the chairperson of Moscow City Court, Olga Yegorova, but on July 4 she upheld Vodolyanova’s decision.
